TwishTwish! Terms of Service
These Terms of Service (“Terms”) govern your use of the Twish! Twitch Extension, the Twish! hosted chat bot, and the Twish! game servers (together, the “Service”), operated by the developer of Twish! (“Twish!”, “we”, “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Twish! is a free fishing minigame that runs inside Twitch as an extension overlay and panel, with an optional chat-command mode provided by a hosted chat bot. Twish! is a third-party product and is not affiliated with, endorsed by, or sponsored by Twitch Interactive, Inc. Your use of Twitch itself — including your Twitch account, chat, and Bits — is governed by Twitch’s Terms of Service and related policies, which apply in addition to these Terms.
2. Eligibility
You must have a Twitch account in good standing and meet Twitch’s minimum age requirement (13 years, or older where local law requires) to use the Service.
3. Virtual items
The Service includes virtual items such as fish, coins, XP, baits, equipment, cosmetics, and titles (“Virtual Items”). You acknowledge and agree that:
- Virtual Items have no monetary value. They are game content, nothing more.
- Virtual Items cannot be cashed out, redeemed, or exchanged for money, goods, or anything of value outside the Service.
- Virtual Items are non-transferable. There is no trading or selling of Virtual Items between users, and any attempt to buy or sell Virtual Items outside the Service is prohibited. (The in-Service gift option grants a newly purchased item directly to the recipient at checkout — owned items are never transferred.)
- Virtual Items are licensed, not sold. We grant you a limited, revocable, non-exclusive, non-transferable license to use Virtual Items within the Service. You do not own them.
- We may add, modify, rebalance, or remove Virtual Items and game mechanics at any time as part of operating and improving the game.
4. Bits
Some Virtual Items and channel effects can be unlocked using Twitch Bits. All Bits transactions are conducted and processed entirely by Twitch. The acquisition and use of Bits are governed by the Twitch Terms of Sale and Twitch’s Bits Acceptable Use Policy — not by us. We never receive or store your payment details. Bits used in the Service are consumed per Twitch’s rules and are not refundable by us; any refund questions for Bits themselves are handled by Twitch.
Items unlocked with Bits are Virtual Items under Section 3: they have no monetary value and cannot be cashed out or transferred. Channel-wide effects (for example, community boosts and tournaments) benefit all players in the channel and confer no competitive advantage, prize eligibility, or special treatment on the person who activated them beyond the described in-game effect.
If we ever need to restore the game database from a backup — for example, to recover from data loss or corruption — we will make every reasonable effort to preserve Bits-unlocked items on each affected account.
5. Fair play
You agree not to:
- automate gameplay (bots, scripts, macros) or use exploits, bugs, or unauthorized third-party tools to gain an advantage;
- interfere with, overload, reverse engineer, or disrupt the Service or its APIs;
- harass other players or use the Service in a way that violates Twitch’s Community Guidelines or applicable law.
We may rate limit, reset progress obtained through abuse, or suspend or terminate access for violations.
6. Broadcasters
Broadcasters who install the extension choose where and how it appears on their channel and may enable or disable features (including chat fishing) in the extension configuration. Broadcasters are responsible for complying with Twitch’s rules for extensions on their own channel. Revenue sharing for Bits used in extensions, if any, is determined and administered solely by Twitch under Twitch’s developer and monetization agreements; we make no promises about broadcaster earnings.
7. Availability; changes to the Service
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-interruption. We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice, including permanently shutting it down. Because Virtual Items have no monetary value, no compensation is owed for changes to, loss of, or removal of Virtual Items or the Service.
8. Termination
You may stop using the Service at any time; broadcasters may uninstall the extension at any time. We may suspend or terminate your access to the Service at any time for violation of these Terms, for abuse of the Service, or if the Service is discontinued. Sections 3, 7, 9, and 10 survive termination.
9. Limitation of liability
To the maximum extent permitted by law, Twish! and its developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to the Service. To the extent any liability is not excludable, our total aggregate liability is limited to fifty (50) US dollars. Nothing in these Terms excludes liability that cannot be excluded under applicable law, and nothing in these Terms limits any rights or remedies you have against Twitch under Twitch’s own terms.
10. General
These Terms are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules.
11. Changes to these Terms
We may update these Terms as the Service evolves. Material changes will be reflected here with a new effective date; continued use of the Service after changes take effect constitutes acceptance. This page is always the current version.
